INFORMATION OBLIGATION ON PERSONAL DATA PROTECTION

In order to fulfil the obligation under art. 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as ‘GDPR’) – we present the following information concerning the processing of your personal data by the Controller:

1. CONTROLLER

2. PROCESSED PERSONAL DATA

Data are processed in accordance with current regulations, in particular in accordance with the provisions of the General Data Protection Regulation (GDPR). We process data you have provided to us through various communication channels, including in writing, by e-mail or by telephone. The data might have been communicated to us in different situations, e.g. within the framework of our cooperation, during the execution of an agreement for the sale of pleated blinds or roller blinds which are available in our offer or services provided by us. Your personal data might have also been acquired by us from different sources, e.g. from your contractors with whom we also cooperate as our clients. Your personal data will be processed under art. 6 par. 1 letter a) – c) of the GDPR in order to establish cooperation, conclude and exercise a sales agreement, provide services, reply to all questions or applications addressed to us, send further correspondence in this respect, marketing and communication regarding the said information and services as well as to exercise legal obligations imposed on us, establish, exercise and defend claims, handling complaints, financial settlements, including the issuing of accounting documents. Data subjects include our clients, contractors, potential contractors and their employees, representatives and individuals cooperating with them. With regard to the business relations and communication we can process the following data: identification data, contact data, data concerning the job title and professional qualifications, other data communicated to us in connection with cooperation or communication.

3. METHODS OF DATA PROCESSING

The internal procedures implemented by us ensure that the collected data are: processed lawfully, fairly and in a transparent manner in relation to the data subject; collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes; adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed; accurate and, where necessary, kept up to date; kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; processed in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures.

4. SOURCE OF PERSONAL DATA

The processed personal data are communicated to us directly by data subjects or other processors with whom we cooperate or from publicly available sources.

5. RECIPIENTS OF PERSONAL DATA

We can transfer the processed personal data to entities which cooperate with us for the purpose of proper performance of an agreement concluded between us or additional services related to the said agreement. Your data can be transferred to entities which cooperate with us on the basis of a personal data processing agreement. This pertains, for instance, to entities which provide us with consulting services, legal aid, tax aid, accounting aid, forwarding and transport services, postal and courier services.

6. DATA RETENTION PERIOD

Personal data will be retained for no longer than necessary to meet the aforementioned objectives and as specified by applicable provisions, in particular time limits specified in the Tax Ordinance Act and the period of limitation of claims arising from the Civil Code. Upon expiry of the agreement, the controller will process your data, provided that there is basis for further processing, for period resulting from the provisions of law of your consent.

7. AUTOMATED DECISION-MAKING

We do not make decisions based on automated processing, including profiling, of personal data.

8. PERSONAL DATA TRANSFER OUTSIDE THE EUROPEAN ECONOMIC AREA

Your data is not transferred outside the European Economic Area. If your data were to be transferred outside the EEA in the future, we will take appropriate steps to protect your data, in particular through: the use of specific contractual clauses referred to as ‘standard contractual clauses’ which have been approved by the European Commission; or transfer to countries for which the European Commission has confirmed a suitable level of protection. In such a case, you have the right to obtain a copy of suitable safeguards.

9. RIGHTS RELATED TO THE PROCESSING OF DATA

To the extent and based on principles specified in the GDPR you have the right of access to data, including to obtain a copy thereof, the right to rectification, erasure and restriction of processing, to object to processing, to transmit data to another controller (insofar as the processing thereof is based on a necessity to perform an agreement or your consent). If data is processed on the basis of consent, you have the right to withdraw it at any time without affecting the lawfulness of processing based on consent before its withdrawal. In order to exercise any of the aforementioned rights, one should send a request indicating the scope of data being the subject of the request via e-mail or mail to the aforementioned addresses. Additionally, you always have the right to lodge a complaint with the President of the Personal Data Protection Office.
